1. Acceptance of Terms

Welcome to ASCII Motion ("Service", "we", "us", or "our"). By accessing or using ASCII Motion, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

ASCII Motion is a web-based application for creating and animating ASCII art. The Service includes:

• Canvas-based ASCII art creation
• Drawing and editing tools
• Animation timeline
• Export to various formats (PNG, JPEG, SVG, MP4, WebM, HTML, TXT, JSON)
• Save up to 3 projects to cloud storage (requires account)
• Unlimited cloud storage with Pro subscription

3. User Accounts

Account Creation:

• You must provide a valid email address to create an account
• You must verify your email address before saving projects to the cloud
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activities that occur under your account

4. Subscription and Payments

Free Tier: Create unlimited projects locally, save up to 3 projects to the cloud.

Pro Subscription: Unlimited cloud storage, priority support, and additional features. Billed monthly ($5/month) or annually ($50/year).

• Subscriptions renew automatically unless cancelled
• You may cancel at any time through your account settings
• Refunds are handled on a case-by-case basis
• Upon cancellation, access continues until the end of the billing period

5. User Content

Ownership: You retain all rights to the ASCII art and animations you create using the Service. We do not claim ownership of your content.

By using the Service, you grant us a limited, non-exclusive license to store your projects on our servers, display your projects back to you, and process your content to provide Service features. This license ends when you delete your content or account.

6. Acceptable Use

You agree NOT to:

• Reverse engineer or decompile the Service
• Attempt to gain unauthorized access to our systems
• Use automated tools to access the Service excessively
• Interfere with other users' use of the Service
• Use the Service to spam or distribute malware
• Violate any applicable laws or regulations

7. Intellectual Property

ASCII Motion, including its design, code, features, and branding, is owned by us and protected by copyright, trademark, and other intellectual property laws. The core editor code is open source under the MIT License.

8. Privacy and Data Protection

We collect and process personal data as described in our Privacy Policy. By using the Service, you consent to our data practices. Upon account deletion, all personal data is permanently removed within 30 days.

9. Service Availability

No Warranty: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR LOSS OF DATA, PROFITS, OR BUSINESS OPPORTUNITIES; INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES; OR ANY DAMAGES EXCEEDING THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.

10. Modifications to Service and Terms

We reserve the right to modify or discontinue features at any time. We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance. Material changes will be announced via email or Service notification.

11. Termination

You may terminate your account at any time through account settings. We may terminate or suspend your account if you violate these Terms, we suspect fraudulent or illegal activity, or we discontinue the Service (with reasonable notice).
